1. Acceptance of Terms

Welcome to OsteoTutor ("we," "our," or "us"). By accessing or using our mobile application and website (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Platform. We recommend printing or saving a copy of these Terms for your records.

2. About Our Platform

OsteoTutor is an educational platform designed to help osteopathy students develop clinical reasoning skills. Our platform provides simulated patient encounters, case studies, and educational content. OsteoTutor does not provide medical advice, diagnosis, or treatment and is not a substitute for professional clinical training or judgement.

By using OsteoTutor, you acknowledge and agree that:

  • The platform is for educational purposes only.
  • You are responsible for all clinical decisions made in your training or practice.
  • OsteoTutor does not replace the need for supervised clinical training, professional osteopathic education, or sound clinical judgement.

3. Eligibility

You must be at least 18 years of age to use the Platform. By using OsteoTutor, you represent and warrant that you are at least 18 years old and that you are an osteopathy student, practitioner, or trainee using the platform for legitimate educational purposes.

4. Account Registration

To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your login credentials.
  • Not share your account with others unless explicitly permitted.
  • Immediately notify us of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

OsteoTutor offers both free and paid ("Pro") subscription plans.

  • Free Plan: Includes limited access to cases and features.
  • Pro Plan: Requires payment of the stated subscription fee (monthly or annually). All fees are charged in advance and are non-refundable except as required by applicable law.
  • Auto-Renewal: Your Pro subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.
  • Price Changes: We reserve the right to change subscription prices. We will notify you of any price changes before they take effect.

6. Acceptable Use

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any applicable law.
  • Attempt to reverse engineer, decompile, or extract the source code of our Platform.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Use any automated system (e.g., bots, scrapers) to access the Platform.
  • Share, sell, or redistribute any content from OsteoTutor without our permission.
  • Upload any content that is defamatory, obscene, or infringes on the rights of others.

7. Intellectual Property

All content, features, and functionality on OsteoTutor—including but not limited to text, graphics, logos, software, and AI-generated case materials—are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your personal educational purposes. You may not copy, modify, or distribute any content from OsteoTutor without our prior written consent.

8. User-Generated Content

You retain ownership of any content you submit (e.g., case notes, diagnoses). By submitting content, you grant us a worldwide, royalty-free licence to use, store, and display that content for the purpose of operating and improving the Platform.

We reserve the right to remove any user content that violates these Terms.

9. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OSTEOTUTOR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OSTEOTUTOR AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR £50 IF YOU HAVE PAID NOTHING.

11. Indemnification

You agree to indemnify and hold harmless OsteoTutor and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the Platform.

12. Third-Party Links

Our Platform may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of those third parties.

13. Modification of Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Platform or via email. Your continued use of OsteoTutor after any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Termination

We may suspend or terminate your access to the Platform at any time, without notice, for conduct that violates these Terms or for any other reason. Upon termination, your right to use the Platform will cease immediately.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
